Cloud 504 Website Hosting Agreement
Effective Date: September 30, 2026
This Website Hosting Agreement (“Agreement”) is between Cloud 504 Technologies LLC (“Cloud 504,” “we,” “us,” or “our”) and the customer purchasing or using Cloud 504 Website Hosting (“Customer,” “you,” or “your”). By purchasing Website Hosting, checking the hosting-agreement acceptance box at checkout, renewing the service, or continuing to use the service, you electronically accept this Agreement.
1. Website Hosting Service
Cloud 504 provides managed website hosting using commercial hosting infrastructure and related third-party technologies. Our current hosting platform may include Hostinger infrastructure and other third-party services. Cloud 504 may change hosting providers, server locations, software, caching systems, security tools, or other underlying technologies when reasonably necessary to maintain, secure, improve, or support the service.
Your Website Hosting plan is designed to provide more than basic server space. Depending on the website, platform, provider capabilities, and technical compatibility, the managed hosting environment may include:
- Managed business-grade web hosting for supported websites and WordPress installations.
- Content Delivery Network (CDN) and edge caching to serve eligible website assets from network locations closer to visitors and improve delivery speed.
- Object Cache for supported WordPress sites, using in-memory caching to reduce repeated database work and improve dynamic-site performance.
- Server-side and page caching to improve page delivery and reduce unnecessary server processing.
- SSL/TLS certificate management for HTTPS encryption on supported domains.
- Daily automated backups through the hosting platform, together with available restore tools.
- Malware and malicious-file scanning provided through the hosting environment and related security tools.
- Hosting-provider network and server security controls, which may include firewall, abuse-prevention, DDoS-mitigation, or similar protections.
- WordPress, PHP, and database hosting, including access to supported hosting-level configuration tools.
- Resource monitoring and hosting diagnostics for server usage, availability, and common hosting-related issues.
- DNS and SSL assistance when reasonably required to connect the hosted website to the Cloud 504-managed hosting environment.
- Cache management and performance tools, including cache flushing and supported performance configuration.
- Hosting administration by Cloud 504, so the Customer does not need to manage Cloud 504’s master hosting account or the underlying hosting platform.
Specific provider features, names, limits, or technologies can change. Cloud 504 may substitute a comparable hosting, caching, backup, security, or performance technology without amending this Agreement, provided the overall hosting service remains substantially similar.
2. Pricing and Billing
Website Hosting is currently offered at $39 per month or $399 per year, based on the billing option selected at purchase. Charges are paid in advance for the applicable billing period. Taxes, domain fees, third-party licenses, and separately purchased services may be additional.
When the selected payment method and checkout system support recurring payments, Website Hosting automatically renews at the end of each billing period until canceled. If automatic charging is not supported, Cloud 504 may issue a renewal invoice or payment request.
Cloud 504 may change future hosting prices by providing reasonable advance notice. A price change will apply no earlier than the Customer’s next renewal after the notice period.
3. Cancellation and Non-Renewal
You may cancel future renewal of Website Hosting at any time before the next renewal charge. Cancellation does not normally create a prorated refund for the current billing period. Except where required by law or otherwise approved by Cloud 504, fees already charged for the current hosting period are non-refundable once that period has begun.
Hosting remains available through the end of the paid period unless the service is suspended or terminated for nonpayment, security concerns, prohibited use, or another material breach of this Agreement.
4. Services Not Included
Unless separately stated in an order, quote, invoice, or service agreement, Website Hosting does not include:
- Domain registration, transfer, or domain renewal fees.
- Business email or mailbox services.
- Website redesign, page creation, content entry, copywriting, or ongoing content changes.
- SEO campaigns, advertising, social media management, or marketing services.
- Ongoing WordPress core, theme, or plugin maintenance unless purchased separately.
- Premium themes, plugins, fonts, stock media, software subscriptions, or other third-party licenses.
- Custom development, programming, integrations, or troubleshooting unrelated to the hosting environment.
- Major website migrations, emergency repairs, malware remediation, database cleanup, hacked-site recovery, or site reconstruction unless separately quoted.
- Unlimited storage, bandwidth, CPU, memory, email, database use, or other server resources.
5. Customer Responsibilities
The Customer is responsible for the legality, accuracy, ownership, licensing, and operation of the Customer’s website content, accounts, applications, themes, plugins, databases, credentials, and business practices. The Customer must maintain current contact and billing information and must promptly notify Cloud 504 of suspected compromise or unauthorized access.
The Customer is responsible for maintaining independent copies of irreplaceable business data, website content, customer records, and other important information. Hosting-platform backups are an operational convenience and recovery tool, not a substitute for the Customer’s own records or legal retention obligations.
6. Acceptable Use
You may not use the service for unlawful activity, malware distribution, phishing, credential theft, spam, denial-of-service activity, unauthorized access, network attacks, abusive automation, copyright or trademark infringement, or activity that threatens the security, stability, reputation, or availability of Cloud 504, its providers, other customers, or third parties.
Cloud 504 may temporarily restrict or suspend a website when reasonably necessary to investigate or stop security threats, provider abuse notices, excessive resource usage, nonpayment, illegal activity, or conduct that could harm the hosting environment.
7. Backups and Data Recovery
Cloud 504’s managed hosting environment may provide automated backups and restore points. Backup frequency, retention periods, restore capabilities, and storage methods may depend on the current hosting provider and plan. Cloud 504 does not guarantee that every backup will be complete, current, uncorrupted, or suitable for every recovery scenario.
Cloud 504 may assist with a standard hosting-platform restore when reasonably available. Extensive recovery, manual database repair, malware cleanup, content reconstruction, or recovery caused by Customer actions may require a separate service charge.
8. Security
Cloud 504 uses commercially reasonable hosting and security tools intended to reduce common website and server risks. These may include SSL, malware scanning, caching protections, provider firewalls, account controls, monitoring, updates to the hosting stack, and other safeguards. No website, server, network, backup, firewall, scanner, or security product can guarantee that a site will never be attacked, compromised, interrupted, or lose data.
The Customer must use strong credentials, appropriately control administrator access, maintain lawful and properly licensed software, and cooperate with reasonable security steps requested by Cloud 504.
9. Availability, Maintenance, and Performance
Cloud 504 will use commercially reasonable efforts to keep hosted websites available and the hosting environment functioning properly. Unless Cloud 504 provides a separate written Service Level Agreement, Website Hosting does not include a guaranteed uptime percentage, guaranteed page-load time, guaranteed search ranking, or guaranteed uninterrupted operation.
Availability and performance can be affected by maintenance, software conflicts, third-party services, DNS, internet routing, attacks, upstream providers, plugins, themes, external APIs, Customer changes, and events outside Cloud 504’s reasonable control.
10. Third-Party Infrastructure and Software
Cloud 504 may use third-party hosting providers, CDNs, security services, software, plugins, libraries, control panels, payment processors, or other technology to deliver Website Hosting. These providers may change their features, limits, availability, or terms. Cloud 504 may modify or replace third-party components when reasonably required to operate the service.
Third-party licenses that are not expressly included in the Website Hosting plan remain the Customer’s responsibility.
11. Website Ownership and Hosting Account Access
The Customer retains ownership of the Customer’s original website content, branding, data, and other materials the Customer owns. Purchasing Website Hosting does not transfer ownership of Cloud 504’s master hosting account, infrastructure accounts, management systems, tools, configurations, processes, licenses, or other Cloud 504 property.
For security and account-separation reasons, Cloud 504 is not required to provide the Customer with credentials to Cloud 504’s master Hostinger account or any other shared provider account. Cloud 504 may instead provide website-level access, exports, backups, or migration assistance as appropriate.
12. Migration and End of Service
If Website Hosting ends, the Customer is responsible for arranging migration or obtaining needed website files and database exports before the service is removed. Cloud 504 may offer migration assistance for a separate fee.
After termination, Cloud 504 may remove the website and related data from its active hosting environment. Cloud 504 may retain temporary backups for operational purposes, but is not obligated to maintain or recover Customer data after the hosting service ends.
13. Suspension and Termination
Cloud 504 may suspend or terminate Website Hosting for material nonpayment, prohibited use, security threats, provider requirements, repeated resource abuse, fraud, chargebacks, illegal activity, or material breach of this Agreement. When practical and safe, Cloud 504 will attempt to provide notice and an opportunity to correct the issue before permanent termination.
14. Disclaimer of Warranties
Except for any express written promise made by Cloud 504, the hosting service is provided on an “as available” basis. Cloud 504 does not warrant that the service will be error-free, uninterrupted, immune from attack, compatible with every plugin or application, or suitable for every Customer requirement.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Cloud 504 will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages, including lost profits, lost revenue, lost business opportunities, loss of goodwill, or loss of data, arising from or related to Website Hosting.
To the maximum extent permitted by applicable law, Cloud 504’s aggregate liability arising from Website Hosting will not exceed the amount the Customer paid Cloud 504 for Website Hosting during the twelve months immediately preceding the event giving rise to the claim.
16. Customer Indemnification
To the extent permitted by law, the Customer agrees to defend, indemnify, and hold Cloud 504 harmless from third-party claims arising from the Customer’s website content, unlawful conduct, infringement, misuse of the service, or material violation of this Agreement, except to the extent caused by Cloud 504’s own unlawful conduct.
17. Force Majeure
Cloud 504 is not responsible for delay or failure caused by events beyond its reasonable control, including utility failures, internet or telecommunications outages, upstream hosting failures, natural disasters, government actions, labor disruptions, widespread cyberattacks, or other force-majeure events.
18. Changes to This Agreement
Cloud 504 may update this Agreement to reflect changes in the hosting service, providers, security requirements, laws, or business practices. Material changes will apply prospectively and Cloud 504 will provide reasonable notice when required. Continued use or renewal after the effective date of an updated Agreement constitutes acceptance of the updated terms to the extent permitted by law.
19. Governing Law
This Agreement is governed by the laws of the State of Texas, without regard to conflict-of-law principles. Unless applicable law requires otherwise, disputes relating to this Agreement will be brought in a court of competent jurisdiction located in the Texas county where Cloud 504’s principal office is located.
20. General Terms
If any provision of this Agreement is found unenforceable, the remaining provisions will remain in effect. A waiver of one breach is not a waiver of another. The Website Hosting order, this Agreement, and any separately signed Cloud 504 service agreement applicable to the same service constitute the agreement between the parties concerning Website Hosting. If a separately signed agreement expressly conflicts with this Agreement, the separately signed agreement controls for that conflict.
21. Electronic Acceptance
By checking the Website Hosting Agreement box during checkout, purchasing or renewing Website Hosting, or otherwise electronically accepting these terms, the Customer confirms that the Customer has read, understands, and agrees to this Agreement and has authority to accept it for the person or organization purchasing the service.
